CONTEST TERMS AND CONDITIONS

1. INTRODUCTION

The following Terms and Conditions apply for GUNDU STAGE TO FAME SMS Contest (hereinafter referred to as the “Contest”) to be run on Dream Mobile (hereinafter referred to as the “Content Provider”) and shall be binding on all persons (“Contestant”) entering into this Contest. Entry and participation in this Contest shall be deemed an unconditional acceptance by a Contestant of all terms and conditions.

These terms and conditions can be collected at Dream Chorus Sdn Bhd, Suite 12-13,14 & 15, 12th Floor, Wisma UOA 2, No. 21 Jalan Pinang, 50450 Kuala Lumpur  and can be viewed from www.dreammobile.com.my (“the website”).

2. ORGANISER

The Organiser is Dream Chorus Sdn Bhd, Suite 12-13,14 & 15, 12th Floor, Wisma UOA 2, No. 21 Jalan Pinang, 50450 Kuala Lumpur  (the“Organiser”).

3. DURATION

Contesting will occur between 24 November 2009 and 3 December 2009 inclusive (“Contesting Days”). The Organiser reserves the right to extend the Contest period at its own discretion.

4. ELIGIBILITY

Entry is available to all Malaysian residents aged 18 years or over OR in the event that the participant is under the age of 18 years old, their parent/guardian may at the absolute discretion of the Organiser be required to sign an indemnity in the form required by the Organiser as a precondition to their child’s entitlement to the prize(s).

Employees and the immediate families of the Organiser, Dream Chorus Sdn. Bhd. and its subsidiaries and affiliates are ineligible to enter. Employees and the immediate families of all associated sponsors and participating companies are
also ineligible to enter.

5. METHOD OF ENTRY

To enter:

Incomplete or illegible entries (whichever is applicable) will not be eligible and will be disqualified. The Organiser reserves the right to disqualify any entry which in the opinion of the Organiser includes any content which may be unlawful, profane, inflammatory, defamatory and/or damaging to the goodwill or reputation of the Organiser.
Any person who is discovered to have used or attempted to use more than one name or providing false information in entering the Contest will be disqualified from participating in the Contest and/or redeeming a prize.

The Contestant acknowledges and agrees that the Organiser reserves the right to disqualify a winner in the event that the Organiser learns of his/her ineligibility after awarding the prize to him/her. In such event, the Organiser reserves the right to demand for the return of the prize(s) or payment of its value from the ineligible person/parent/guardian.
Should an entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify the Organiser. A request to access or modify any information provided in an entry should be directed to the Organiser.

Each SMS is charged at 50 cents HOWEVER standard telco charges apply. To enter, entrants will need an SMS compatible mobile phone connected to a service provider that permits text messaging to the abovementioned premium SMS number. It is recommended that entrants check with their individual service provider in this regard.

6. CONTEST MECHANICS

(b) Select preferred language(Bahasa Melayu or English Only) by sending GG BM or GG ENG to 33266
(c) Answer 5 questions given by sending GG A or GG B to 33266
(c) Complete a slogan by sending GG SLOGAN I LIKE GUNDU BECAUSE.. and send to 33266

7. PRIZE(s)

Claims
All Prizes must be collected within three(3) hours before the event, 03.00pm 05 December 2009 or on Friday, 4th November 2009 (“Collection Period”). Winners are solely responsible for the collection of their Prize, and the Organiser shall not be obliged to give notice of the Prize collection date line. Prizes which have not been claimed within the Collection Period shall be forfeited by the Organiser and the Organiser, its agents, sponsors and representatives shall have no liability to the Winner in any respect whatsoever.

Prizes must be claimed in person unless the Organiser advises otherwise. Identification which includes a photograph will be required (examples include identification card/drivers licence/passport which displays a photograph of the Winner). Where the Organiser elects to post a Prize to a Winner no responsibility will be accepted by the Organiser for the safe and effective postal delivery of the Prize.

In special situations, and subject to the absolute discretion of the Organiser, a Winner may nominate a designated representative to collect a Prize. The representative will be required to present written authorisation from the Winner and identification which includes a photograph for both the Winner and their representative.

In the event that a Winner chooses not to accept a Prize, they will have to sign a “Letter of Forfeiture” provided by the Organiser and forfeit any and all claims to that Prize, which will be dealt with according to the absolute discretion of the Organiser. No prize replacement claim will be entertained.

Transfer and utilisation of Prizes
Prizes are non transferable, and where applicable, must be used on the dates specified and may not be redeemed for cash or other alternatives. All Prizes are accepted entirely at the risk of the Winner, and the Organiser excludes all
warranties in connection with any Prize to the extent permitted by law.

If a specified Prize becomes unavailable, the Organiser may substitute a replacement Prize at its absolute discretion.

8. NOTIFICATION
All prize winner(s) will be notified winning by telephone and then by SMS. If the Organiser does not receive a response to our SMS within Collection Period the prize will be forfeited.
The Organiser will not be responsible for any SMS not received or sent by winners due to mobile operators’ system failure, etc.

9. TAXES
Winners are responsible for any and all taxes payable as a result of a Prize being awarded or received.

10. UNCLAIMED PRIZES
Prizes unclaimed after a period of three (3) hours from Collection Period will be forfeited.

11. PUBLICITY MATERIALS AND COPYRIGHT
Contestants may be required by the Organiser to participate in interviews, photo, video and/or film sessions and acknowledge that the Organiser has the right to use such interviews, publicity photos, videos and/or films in any medium and in any reasonable manner it sees fit, without payment of any compensation whatsoever.
Contest entries and material (“Materials”) submitted in connection with any Contest (whether in written, audio, electronic or visual form, or a combination of those) or any photographs, video and/or film footage and/or audio recording taken of Contestants become the property of the Organiser which may use the material in any medium and in any reasonable manner it sees fit. Copyright in the Materials shall vest absolutely in the Organiser.

The Organiser may incorporate information from Contestants in any data base for use in the ordinary course of its business. The Contestant shall not without the specific prior written consent of the Organiser publish or disclose any information in connection with the Contest or the Prize (without limitation to representatives of media in whatsoever form). The Contestant shall not be entitled to give interviews or be involved in articles or reports in respect of the Contest or the Prize with any third party.

The Contestant hereby grants and assigns to the Organiser the entire copyright and other intellectual property rights in the Contest and its involvement in the Contest in all media and technology.

12. RELEASE AND INDEMNITY
To the extent permitted by law, all entrants release from, and indemnify the Organiser against all liability, cost, loss or expense arising out of acceptance of any prize(s) or participation in the Contest including (but not limited to) loss of income, loss of opportunity, personal injury and damage to property, whether direct or consequential, foreseeable, due to some negligent act or omission or otherwise.

13. LINE DROP OUT AND INABILITY TO CONTACT

Short Messaging Service (SMS) Contest
The Organiser shall not be responsible or liable for any problem, loss or damage of whatsoever nature suffered by any party due to any delay and/or failure in receiving and sending an SMS as a result of any network, communication or system error, interruption and/or failure experienced by the participating mobile phone operators and/or by the Organiser and/or resulting from participation or the downloading of any materials in the Contest. In the event of such error, interruption and/or failure, the Organiser shall not be responsible or liable for any failure by any Contestant to participate in the Contest at any time. The Organiser shall not be responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of,
or unauthorized access to entries, or entries lost or delayed whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes outside its control.

In the event where the Contest requires SMS registration, the Organiser shall have the right to call/nominate next best Contestant/Winner if the Organiser is unable to reach the current/existing Contestant/Winner.
If a Contestant is suspected of cheating or manipulating the system which may affect the results of the Contest, the Organiser may in its absolute discretion terminate the Contest immediately.

14. LEAVE FOR PARTICIPATION
Obtaining time off work and/or study or related activities to participate in the Contest and/or a prize will be the sole and absolute responsibility of each contestant.

15. EXCLUSION OF PARTICIPANTS
The Promoter reserves the right to exclude any person from participating in the Contest or a prize for any reason, including but not limited to, that person’s medical condition or history, the preservation of the safety of the Promoter’s staff members or any other person or because the Promoter deems that the behaviour of a person may bring the Promoter’s brand into disrepute.

16. MINORS
If the prize winner is under the age of 18 years these terms and conditions must be signed by the prize winner’s parent or legal guardian before the prize is awarded and the prize may at the absolute discretion of the Organiser be awarded to the prize winner’s parent or legal guardian.

17. TERMINATION OF CONTEST
The Organizer may terminate this Contest at any time at its absolute discretion without liability to any Contestant or other person at anytime without giving any reason whatsoever.

18. DECISIONS FINAL
All matters or decisions relating to this Contest, Prize and these terms and conditions shall be final and cannot be contested. No correspondence or discussions will be entertained.

19. FAILURE TO ENFORCE TERMS AND CONDITIONS
A failure by the Organiser to enforce any of these terms and conditions in any instance(s) will not give rise to any claim by any person.

20. PERSONAL INFORMATION AND PRIVACY
The personal information supplied by entrants when entering this Contest will be used by the Organiser in accordance with its Privacy Policy. Please refer to the Privacy Policy by visiting the website for more information as entry in this  Contest is an agreement to be bound by that policy.

21. GENERAL
The Contestant is obliged to take all reasonable steps to ensure the safety standards and the general appropriateness of activities undertaken during the Contest and acknowledges that all activities are undertaken at its own risk.
The Organiser reserves the right to forfeit the Contestant’s place on the Contest or the Prize (without liability or compensation) if, in its opinion, the Contestant may expose the Contestant’s self or others to risk of illness or injury or to the cancellation, disruption, or curtailment of the Contest.

These terms and conditions shall be governed by and construed in accordance with the laws of Malaysia.
Except as specifically set out herein, all conditions, warranties and representations expressed or implied by law are excluded. For the avoidance of doubt, no information of any nature about the Contest or the Prize or any of these Rules should be relied upon unless confirmed in writing by the Organiser. The invalidity, illegality, or unenforceability of the whole or part of the Rules does not affect or impair the continuation in force of the remainder of the Rules.

Grant of Licence

You hereby grant to Gundu.my a non-exclusive, non-transferable and non-sublicensable licence in the Mobile Content (in whole or in part) for Gundu.my’s sole purpose of providing the Ring Back Tone service called Call Me Tones from the audio content uploaded under the category of "Call Me Tones".

You acknowledge that the Report and the Records has to be reconciled with the records of the Carrier. In the event of any discrepancies, Gundu.my shall be entitled to update the Report and the Record and amend the statement of Royalties accordingly.


Publishing Fee

With respect to all Mobile Contents which embody sound recordings:-

(a)        You shall be the party responsible for obtaining all rights consents and approval to use and reproduce the compositions and literary works subsisting in the Mobile Content (commonly known as “Publishing Licence”) and the Content Provider shall be responsible for accounting and payment of the royalties and fees payable to the copyright owners or their agents (commonly known as “Publishing fees”) in relation to the use and reproduction of the compositions and literary works subsisting in the Mobile Content.

(b)        You shall indemnify and hold Gundu.my harmless against any and all third party claims, actions and/or demands that the use of the compositions and literary works subsisting in the Mobile Content infringes any rights of such third party and shall indemnify Gundu.my against any damages and expenses (including reasonable legal expenses) which may be awarded or agreed to be paid to any such third party in respect of any such claim or action against that other party.


Warranties

You  warrants that:
(a)        it has the power and authority to enter into this Agreement and to perform its obligations hereunder; and
(b)        it is the owner of all rights (including intellectual property rights), title and interests of the Mobile Content.

Gundu.my warrants that
(a)         it will use the Mobile Content only by means of the Permitted Applications and strictly in accordance with the terms of this Agreement; and
(b)        it has the power and authority to enter into this Agreement and to perform its obligations hereunder.

 6. Satu RBT anda akan dijual RM 3.50. RBT anda akan dipapar kan di www.gundu.my dan www.channelx.com.my

8. Kami akan menghubungi anda setelah RBT anda telah dimuat turun sekurang - kurangnya 100 unit untuk proses pembayaran.

9. Anda akan diberi pilihan untuk diserap masuk dalam Syarikat Rakaman yang telah kami lantik setelah jumlah muat turun salah satu atau semua RBT anda mencecah 300 unit. Pelbagai tawaran dan pakej menarik menanti anda.

10. Jumlah muat naik lagu tidak terhad tetapi perlu dimuat naik ke:

a) enjin muat naik audio (upload audio) di bawah kategori "Nada Dering Pemanggil" (untuk demo kepada pendengar)

A – Tidak! Karya ciptaan anda adalah 100% milik anda, Gundu dan PeKOMIK bekerjasama 
  dengan tujuan untuk memartabatkan seni komik di Malaysia serta mencungkil bakat- 
  bakat baru yang sedia ada kemata dunia. Oleh itu, karya anda adalah 100% hakmilik 
  anda. Kami hanya memberikan anda dorongan dan galakan untuk memeriahkan dunia 
  Komik di Malaysia menerusi Gundu.my

Q – Saya mahu Merekacipta rekaan cerita yang berepisod dan berterus-terusan menerusi 
  Adiwira Malaysia, adakah saya layak untuk menyertai Peraduan ini?
A – YA! Anda sudah tentunya layak untuk menyertainya kerana kami mencari mereka 
  yang boleh menghasilkan sesuatu yang kreatif, baru dan asli. Karya anda hendaklah 
  bersertakan Adiwira (Superhero) Malaysia yang baru serta tidak menyerupai mana-
  mana Superhero yang sedia ada, anda juga di kehendaki menyertakan jalan cerita, kuasa 
  superhero serta karakter-karakter utama yang lain di dalam jalan cerita karya anda.

Q – Saya adalah penulis, adakah saya dibenarkan bekerjasama bersama orang lain untuk 
  menyertai Peraduan ini?
A – Peraduan ini lebih memberi fokus kepada mencari Adiwira Malaysia yang baru dan asli. 
  Oleh itu pihak kami tidak akan bertanggungjawab di atas segala kolaborasi yang tidak 
  menjadi. Galakan di beri kepada mereka yang berminat untuk berkolaborasi tetapi 
  mereka yang ingin melakukan kolaborasi hendaklah mendapat persetujuan pihak lain 
  terlebih dahulu sebelum anda meneruskan kolaborasi anda bersama.

Q – Apakah bentuk saiz dokumen yang perlu saya selitkan untuk menghantarkan karya?
A – Semua karya anda hendaklah di Upload di website Gundu.my ataupun emailkan kepada  
  teamgundu@gundu.com.my. Kesemua karya anda akan di paparkan kepada umum di Gundu.my. 

Oleh itu, anda d galakkan untuk menghantar karya anda sebanyak mungkin. 

Q – Apakah maksud dan peranan sebenar Gundu.my dan juga PeKOMIK di dalam Peraduan 
  ini?
A – Gundu.my dan PeKOMIK bekerjasama bersama untuk memberi galakan kepada umum 
  tentang komik. Kami ingin memberi galakan yang besar kepada pencinta seni komik 
  serta ingin memartabatkan seni komik di Malaysia. Gundu.my bertindak sebagai 
  platform untuk peserta memaparkan karya mereka kepada umum, manakala PeKOMIK 
  pula bertindak sebagai mereka yang menyumbang karya-karya ciptaan mereka kepada 
  Gundu.my untuk mempromosi dan memaparkan karya mereka kepada umum.

Q – Adakah saya di larang untuk mereka karya ciptaan saya yang lain ataupun menyertai  
  Peraduan yang lain jika saya memenangi Peraduan ini?
A – Tidak! Anda tidak akan terikat dengan kami dalam apa jua situasi sekali pun, Peraduan  
  ini bertujuan hanyalah untuk mencari bakat-bakat baru pecinta seni komik.

Q – Saya bukan warganegara Malaysia tetapi saya masih ingin mencuba, adakah saya layak 
       untuk menyertai peraduan ini?
A – Maaf Peraduan ini dibuka hanya untuk warganegara Malaysia sahaja. Mereka yang 
       bukan warganegara Malaysia tidak dibenarkan untuk menyertai Peraduan ini. Sebarang 
       kesulitan amat dikesali.

Q – Perlukah saya menandatangani karya ciptaan saya?
A – Anda tidak diwajibkan untuk menandatangani karya ciptaan sendiri. Anda tidak perlu 
       meletakkan informasi tentang diri anda kerana di Gundu.my kami mempunyai sistem 
      data automatik yang membolehkan kami untuk mencari peserta Adiwira Malaysia 2009 dengan

Any individual or groups with an interest in reaching out to the public in promoting their creativity and talents, who is willing to uphold Gundu’s Terms of Use and Privacy Policy may become a member of Gundu.

Is Gundu considering the adoption of the set of guidelines?
Any set of guidelines published by Gundu will be voluntary and are not binding on members who do not elect to adopt the statement. However, Gundu will take action where appropriate.

How much does it cost to join?
Membership is F-R-E-E and open to all Malaysian.

Do I have to be a professional to join Gundu?
No. The Gundu registered members are comprised of people from many backgrounds and disciplines and includes musicians, artists, students, and professionals.

Are there any rules I have to follow?

If you think our logo is awful, unattractive, and not sexy enough or you have full of creative ideas in your mind, lets change it. And hey, you may end up with A Brand New iMac.

And to avoid any unnecessary disqualification, take your 5 minutes to go through the following very, very careful before you get to work on your logo design. Entries that do not follow these guidelines may be disqualified from the competition.

1. To enter Logo Design Contest (“Contest”) , first you must become a Gundu member by registering at Gundu.com.my. (“Gundu”).

2. All entries must be uploaded to Gundu, under 'GUNDU Logo Contest' image category by 21st September 2008.

3. Logos may be submitted by individuals or as a group. Submissions are open to all registered Gundu members.

4. You may submit as many designs as you wish as long as the creation originally yours.

5. The logo should reflect the independent concept of Gundu which has always been central to the identity and vision.

6. Your design must incorporate the word "Gundu".

7. The purple and something green throughout this website are not the color of Gundu so go ahead and play around with any color.

8. Your design must have a purpose and please provide description detailing your design.

9. Please follow the following format:

All logos must be submitted in laid out horizontally (landscape-style).

Logos should not be larger than 300x100 pixels. 
The logo should be appropriate for use in both Web and print materials. Therefore, we would like you to submit:

A PNG, GIF, or JPG version optimized for the Web (at least 72 dpi)

A 600 dpi (or higher) PNG, PSD, TIFF, or RAW file for use in print materials (you may also submit the original vector file if it is smaller than 5M)

10. Please note that all the winning entries, become the property of the Gundu. By submitting an entry, you understand and agree that Gundu may use, modify, register, and/or reproduce your logo design without limitation, and may do so without obtaining your permission or granting you any additional compensation.

The Gundu.com.my (“Gundu”) Contest “Share Your Creativity, Win A Mac Mini” (“Contest”) is open to all registered member of Gundu. To become of a registered member, login to Gundu’s website at: www.gundu.com.my and complete the on-line registration form.

To participate in the Contest, members are required to upload their own creation of video, audio or image on the Gundu portal as many as possible. However, for the contest only video or audio contents upload is counted and the contents must fall under either one of the following categories:

• Entertainment
• Live Performance
• Street Performance
• Studio Recording

Members will be required to complete the rest of the information field related to the video or audio upload.
Members will be required to provide a phone number (which will not be published) so that they can be contacted in case their video or audio is selected as the most uploaded content.

Members may enter as many video or audio content as they like to stand more chance to with this contest.

2. CONTEST PERIOD

The Contest period shall run from 28 August 2008 until 31 August 2008, inclusive (“Contest Period”). BY POPULAR REQUEST EXTENDED TO 21 September 2008.

3. CONDITIONS OF ELIGIBILITY

All registered Gundu members are eligible to participate in the contest except employees of Gundu and its affiliates as well as their immediate family members.

Members agreed that Gundu should bind them with Gundu’s Terms and Conditions and Privacy Policy.

4. SELECTION OF WINNERS

All winners of the contest will be selected based on the highest number of video or audio content uploaded on the Gundu portal, but subject to a minimum of 15 video or audio or both.
 
Gundu reserves the right to use its own creativity judgment to select the winner(s) if there is a tie.

5. PRIZES

The prizes (“Prizes”) for the Contest are as follows: -

• 1x Mac Mini

For the highest number of Video or Audio Uploads

Consolation Prizes

• 30 x Limited Edition of Gundu T-shirt

For the next 30 highest numbers of Video or Audio Uploads

6. GENERAL RULES

6.1 To be declared a winner(s), the potential winner(s) will be notified via telephone call(s) and potential winner(s) must first correctly answer a simple validation question.

6.2 Prize winners shall agree if necessary, to have their name and/or picture, more particularly their photograph, and/or their voices used for advertising purposes connected with this contest, free of charge.

6.3 The names of all Prizewinners will be posted on the Gundu website.

6.4 Each prize shall be accepted as is and may not be exchanged for an amount of money, nor sold nor transferred, except as provided herein. No substitutions will be allowed.

6.5 If it is impossible to supply the prize as described in these regulations, the Gundu and their affiliates reserve the right to substitute for the prize in whole or in part one or more prizes of an approximately equivalent value.

6.6 Refusal to accept a prize releases the Gundu and their affiliates of all responsibility and obligation towards the winner.

6.7 Should a participant make a false statement, he/she shall be automatically disqualified from the contest.

6.8 Gundu and their affiliates shall assume no liability resulting from losses, delays, typographical errors, poor technical or phone operations, loss or stealing of data-processing, breach of software or computer equipment, losses of mail or e-mail, fraudulent calls or any other mistake.

6.9 Gundu and their affiliates shall assume no liability of any kind whatsoever in any cases in which their inability to act results from an event or situation unforeseeable or beyond their control, including a strike, lock-out or any other labor dispute in their place of business or the places of business of the organizations or businesses whose services are used to hold this contest.

6.10 Names, addresses, telephone numbers and email addresses are gathered for the purpose of administering this contest only and will not be used for any other purpose without prior consent. By providing this information, all participants consent to it being used for the stated purposes.

6.11 Participation in this contest includes acceptance of these regulations that shall be applied by Gundu. All its decisions are final.

Use of Gundu Website

Subject upon you agreeing to the Conditions hereinbefore stipulated Gundu hereby grants you permission to access and use the Website subject upon the followings:-

1. You agree to to comply with the Conditions hereinbefore stipulated and all other applicable local, national and international laws, bye-laws and regulations.

2. You agree not to reproduce or distribute in any medium any part of the Gundu Website without Gundu’s prior written approval.

3. You agree not to in anyway modify the Gundu Website and or its features and applications.

4. You agree that you will access the Gundu Website through authorized means and technology that Gundu may designate.

5. You shall not use the Website for any commercial usage without our written approval first had and obtained and for the purpose of this provision ; uploading an original video to promote  your business or artistic enterprise shall not be concluded as prohibited commercial usage.

7. You agree to receive any further update and that Gundu shall have the right to down load and install updates from time to time using any technology and any possible format.

8. You agree not to use or operate or launch any system which may compromise or harm the operation of the Gundu Website in any way, including but not limited to  "robots," "spiders," or "offline readers,"

You agree that you will use the contents and user submitted Video/data for personal use only and that further you will not download, copy, reproduce, distribute, transmit, broadcast, display, sell, license or otherwise exploit such submitted contents for any purposes whatsoever without the prior written consent of the owners thereto.

15. You agree not to compromise, circumvent, disable, prejudice or otherwise interfere with any features and/or applications of the Gundu Website.

16. You acknowledge and agree that Gundu that by using Gundu Website, you will be  exposed to variety submissions which may be inaccurate, offensive, indecent, objectionable. You hereby agree that you will hold Gundu free from any liability and that you shall further indemnify Gundu pursuant to the provisions hereinafter stipulated for any claims arising from such circumstances.
 
17. You agree that Gundu shall not be responsible for user submissions accuracy, usefulness, safety or intellectual  proprietary rights and that you shall further indemnify Gundu and hold Gundu harmless against any claim which may arise therefrom.

18. You agree that Gundu does not guarantee any confidentiality in respect of user submissions.

19. You agree that you shall be solely responsible for your own user submissions and the consequences of submitting them.

20. You agree that by submitting such user submissions you warrant and/or represent that you own or have the necessary licenses, rights, consents and permissions to use and authorize Gundu to use the intellectual proprietary rights to such user submissions and use the said submission in the manner contemplated hereunder.

21. Your act of submitting the Video and text content for all intention and purposes shall be construed as :-

(a) granting Gundu an irrevocable license to use, reproduce, distribute, display and perform the user submissions in any way  Gundu deems fit.

(b) Granting each user of the Gundu Website, license to access your user submissions and to use, reproduce, distribute, display and perform such user submissions.
 
(c) You agree that Gundu reserves the right to not display, distribute or perform user submissions and yet may retain removed or deleted user submissions.

22. You further agree that you will not submit materials tat is protected under intellectual proprietary rights, trade secrets or materials in breach of privacy/publicity rights unless you are the owner or duly licensed or permitted to post the material and having the authority to grant Gundu the license hereinbefore mentioned.

23. You further agree that you will only submit materials that complies with Gundu’s guidelines as may be issued from time to time and that Gundu reserves the right to remove any user submissions that has been submitted in breach of such guidelines.

Breach of Intellectual Proprietary Rights

1. Gundu does not condone any breach of intellectual proprietary rights and any user submissions displayed shall not be construed as an endorsement by Gundu. Gundu disclaims any liability arising from user submissions.

2. Gundu reserves the right to remove user submissions that infringes on intellectual proprietary rights, pornographic and defamatory materials as well as submission of excessive length and prejudicial to Gundu without prior notice.

Termination of account

1. Gundu reserves the right to terminate any users access to Gundu’s Website for infringement of the Conditions.

Disclaimer and limitation of liability

Gundu disclaims all liability in relation to any of the followings in relation to your use of Gundu Website:-

a. Inaccuracy of content and losses or damage arising from usage of any contents made available through Gundu’s Website.

Opening Account

Gundu reserves the right to request for some personal information when you create an account with us. This personal information may be used to protect your account from unauthorized access.

2. Nobody likes a potty-mouth. Please refrain from swearing or otherwise explicit, abusive, hateful, threatening or insulting language

4. We maintain a zero tolerance policy against harassment, defamation or content that compromises the privacy or safety of yourself or other individuals.
5. Please avoid the malicious use of stereotypes intended to attack or demean a particular gender, sexual orientation, disability, religion, ethnicity or nationality.
